However it is in my husbands name and he has a private mortgage by her former boyfriend's mother. My husband is training camp at the moment and he said to tell me the house I Proxy so I can do. BUT, there was a note written promisary and I need a copy of it before trying to sell because I do not know if she said anything in the note to have the loan promisary repaid before my husband can sell it. The guys we have a loan through hate myself and I know he will not provide a copy of the note promisay, (Ours was stolen by my husbands mother when we moved) so how can I get one? Can I go through the courts and subpoena? How can I do?! I read the note promisary before and I do not remember saying we can not sell before the loan is repaid, but I'm not sure. I just want to do it legally!
To be legal, there should be a copy of the file at the courthouse … go check public records and see if it is. If not, sell the house.
